Yesterday, the California Supreme Court said it would hear appeals that challenge Proposition 8, which outlaws gay marriage and writes discrimination into the state’s constitution. And while the court will hear the appeals, it refused to block the implementation of the measure. That means no more same-sex marriages are allowed and the18,000 couples who were wed over the last five months are in legal limbo.

The American Civil Liberties Union, Lambda Legal and the National Center for Lesbian Rights filed legal challenges to the vote, but it could be March before the court takes up the issue again. That seems like a long damn time to me. Human and civil rights should have never been put on the ballot in California and it shouldn’t linger on a court docket either. It’s especially unfair to those married couples, who are awaiting an uncertain fate.

I joined about 1,500 protestors on the steps of the Georgia State Capitol in Atlanta this past weekend, although if you listened to FOX News there were only “about 300″ of us. The FOX fuckers believe that underreporting the number of protestors will diminish the massive backlash against Prop 8. The Saturday protests around the country are being called “Stonewall 2.0,” which is hyperbole, but it’s hard to ignore the uprising of the GLBTQ community over this issue.

The whole “gay marriage” question didn’t mean very much to me until recently. I’m a confirmed bachelor (how quaint), and marriage as an institution is overrated, but like any flaming liberal, I believe people should be allowed to marry, love, hate and divorce anyone they like. After Georgia wrote discrimination into the state Constitution banning same sex marriage in 2006, I realized that “gay marriage” is just the tip of the iceberg when it comes to human and civil rights for GLBTQ persons. Now, there are rumblings that Georgia will try to ban gay adoption during the 2009 session, bolstered by a ballot measure that passed in Arkansas on Nov. 4.

Bush and Co.’s eight years of pandering to the Christian whackjobs have emboldened the religious right to try and push the GLBTQ back into the closet, and since I tore the hinges off that door when I was 16, I have no plans to go back. My fear is that the GLBTQ community will lose interest in this fight because, let’s face it, there are a lot of flighty queens out there just caught up in the drama. There needs to be sustained pressure on the government and legislators in all states so that the issue remains front and center.

A big shot in the arm would be the Democrats gaining a majority in Congress. I say piss on the “checks and balances” theory bandied about the losing GOP. We’ve been under the Republican thumb for years and now it’s time to reverse the polarity. That means Georgia’s Jim Martin needs to win the runoff against Saxby Chambliss (a right wing nut of the highest order) on Dec. 2 and Al Franken needs to win in Minnesota after the recount. Although democrat Mark Begich has finally won against Ted Stevens in the US Senate race, it still boggles my mind that more than 100,000 would vote for a convicted felon to represent them. Maybe we should encourage the secession of Alaska from the union. Something in the snow ain’t clean up there.

Another brave hope is  - and I know this isn’t polite - that two or three of the U.S. Supreme Court judges will die. Okay, maybe not die, but at least retire so Obama can bring some sanity back to that bench. Maybe with a more liberal-centered top court, we will finally see civil rights for all people. my electric usage was half — HALF! — what it had been this time last year, during a month where i didn’t even go out of town. i didn’t have to make drastic changes to get here, just got in the habit of turning not only the computer, but also the router (you ever feel how HOT those mac airport base stations get?) when i’m not using them. of not letting myself fall asleep reading in bed every night with the light on. (only sometimes.) replaced most of my incandescents with compact fluoros. (take THAT, john mccain.) i still have some regular bulbs, because i hate that fluorescent light with a passion, and if i had to look at myself in the bathroom mirror in eerie operating-roomlike blue light every morning, sooner or later you’d find me swinging from a rope.

am i as green as i could and should be? nah. for a while, my brother dated a woman who was off the electric grid entirely, ran her whole house off a solar-powered generator. she had all kinds of energy-efficient appliances that i’d never even heard of. have you ever seen an insulated refrigerator? i couldn’t even tell what it was until she showed me, and that fridge ran on less juice than a lightbulb. compared with that very gold standard of green, i am an omniverous energarian. so i don’t compare myself with her, generally, i compare my self of today with my selves of the past, and if i can point out incremental improvements on a regular basis, then i am on the right track. the con ed bill is a prime indicator in this process.

not everybody can live off the grid, cheerfully making all the little daily sacrifices and adjustments that involves. (i mean, this woman turned off the light if she stepped out of the room for a SECOND — like, you go to pee and you see there’s no toilet paper and you step over to the closet which is RIGHT there, not four feet away, to get some but you turn the bathroom light off for the micromoment it takes — i doubt she even thought about it, turning shit off had become a total reflex for her, something she would do in her sleep. her mastery of turning things off also worked, eventually, on my brother, but that’s another story.)

getting green, for us non-superhuman type folks, isn’t that hard, and isn’t limited to electricity. i recycle everything now, even envelopes, even the little roll of cardboard from inside the paper towels, the kind kids use as mini-megaphones.  i take totes to the supermarket and walk a couple blocks to bring the few plastic bags i end up with to the CVS recycling center. i flush only when necessary. i use revolving doors whenever possible unless i’m carrying something large and ridiculous. if you’re wondering what’s so green about revolving doors, it’s the way they prevent heat (or air conditioning) escaping from the building and reduce the amount of juice needed to keep the lobby comfy for the security guard who wants to see your ID before letting you inside.

this green thing is getting contagious — the first green billboard has just gone up in times square, powered entirely by solar and wind. i mean, a big ugly hulking neon thing that doesn’t even HAVE a plug attached to it. great news for the obscenity of light that is times square. you ever go there in the middle of a weeknight? like a tuesday-into-wednesday at around 3am? even the winos are asleep, but those glowing, throbbing, spinning, quick-cutting homages to capitalism just keep winking on and off, with nary an eye upon them. so bravo to the ricoh corporation on that.

The vetting of Mr. Clinton’s myriad philanthropic and business dealings is “complicated, and it may be the complications that are causing hesitation on both sides,” said Abner J. Mikva, one of Mr. Obama’s closest supporters and a White House counsel during the Clinton administration. “There would have to be full disclosure as to who all were contributors to his library and foundation. I think they’d have to be made public.”

apparently, serving as secretary of state is far more sensitive than serving as president, since no comparable vetting of presidential candidates — let alone their spouses — is required.

consider sarah palin with her separatist husband and terrorist minister. consider john mccain and the keating 5. there is no test, no set of standards, to be met before running for president (and i’m including the VP post as part of this because the VP is nothing more than a president-in-waiting, with no other job except waiting for the POTUS to die off). and god knows there isn’t any post-election presidential vetting, which is something to be thankful for because such inevitably partisan post-election fingerpointing would guarantee that we never put another human being into the oval office.

that the american political system is completely fucked up is indisputable: from the antique electoral college to 50 different, conflicting sets of state-mandated voting requirements and processes; from the in-depth vetting not only of candidates but spouses for certain roles to the complete absence of vetting standards for others; a palette of institutionalized chestnuts from filibuster to cloture.

those last two are interesting, in that they are rules enacted in the apparent belief that the senate is incapable of having rational, adult discussions about matters on which they are about to vote. in other words, just having a meeting about the pros and cons of…anything…is too difficult for our legislative body to handle unless the entire process is choreographed from the opening curtain down to the final jette. millions of americans have meetings every single day in which important issues are decided, and they somehow manage to struggle through them without such a ludicrous framework.

on the one hand there are so many exquisitely finicky rulings to be observed (and wielded, by those in the know, as weapons) and on the other is a wide-open field where even joe the tax-dodging plumber would be an acceptable candidate for the highest office in the land. the only requirement, apparently, is citizenship.

is there perhaps an assumption that “the american people” would “vet” a candidate publicly their campaign? well, we’ve all just seen how well that one works, and no one puts it better than andrew sullivan at the daily dish:

The impulsive, unvetted selection of a total unknown, with no knowledge of or interest in the wider world, as a replacement president remains one of the most disturbing events in modern American history. That the press felt required to maintain a facade of normalcy for two months - and not to declare the whole thing a farce from start to finish - is a sign of their total loss of nerve. That the Palin absurdity should follow the two-term presidency of another individual utterly out of his depth in national government is particularly troubling. 46 percent of Americans voted for the possibility of this blank slate as president because she somehow echoed their own sense of religious or cultural “identity”. yes, after a bit of post-election decompression i have re-entered my life, dragged out the old goals list, and am getting very, very busy.

i’ve wanted to redesign the site for a while now. yeah, the original template was cool, but also a little buggy, and i’m no back-end CSS expert: i needed a template that would work for me, not against me, so i invested in chris pearson’s Thesis theme and you are looking at the preliminary results.

almost every day i find artists who absolutely knock my kneesocks off, and marcus kwame is one of them. marcus is a poet, a blogger, a musician and a seriously talented painter. i met him a month or two ago (well, it was one of those ‘virtual’ meetings) when he left a couple of very intelligent comments on this blog. intrigued, i headed over to his home base at Bloggin Out and just got floored by his very, very original talent.

this painting was posted under the title “Staff meetings at work make me feel like…” and BOY can i relate to this. i may have to print it out (if that’s ok with him — always, always ask the artist’s permission before using their work for your personal pleasure, however innocent your intentions may be– most of the time the artist is happy to say yes, pleased that you value his work and respect his artistry enough to ask before borrowing the image.)

marcus gets political, too, as in this post about the election, which includes a wonderfully imagined and expertly executed painting of our president elect, on the theme that there has never been anything false about hope. he also maintains a whole separate site devoted to his visual art, where you can buy prints or even some of the originals. i like the fine art gallery best, but you will also find illustrations and even a section for comics. but his very greatest masterpiece, he tells us, is his daughter, born just this past august. congratulations to you and your wife, marcus.

i was scheduled to participate in a panel discussion organized by liveoutloud, which i’d been looking forward to, and had to get there by 7:30. my dayjob is on west 18th, i live on west 116th and the event was being held at the school of visual arts on east 23rd. yeah, enough time to go home after work, but only if i felt like spending an hour on the subway for no good reason. anyway, i’d had an unusual (and inexplicable) craving for fettucine alfredo all day long, so i found an italian restaurant on yahoo local and took myself out for a bite.

the fettucine was delicious! unfortunately, it was also contaminated. yes, another case of the SPLS’s seemed imminent, which i realized about half an hour after eating. in other words, just when i arrived at SVA.

i’ve had food poisoning before, and the odds are that you have too. it’s become more and more common as our food supply grows tainted. sloppy food storage and lax dishwashing techniques also contribute to the problem in this, our nation of slackers.

i once caught a case of food poisoning in the movies. four of us had gone out to dinner beforehand, and about 45 minutes into “wag the dog” three of us abruptly torpedoed toward the bathrooms. there’s that awful miasma at the onset of it: the world swims in a sickly haze, everything gone liquid and thick, head spinning and stomach roiling. i got so dizzy that halfway to the lounge i lost my balance and couldn’t immediately get up again. we’re talking the MOTHER of all food poisonings here. even in my misery, though, i almost laughed when one of the ushers rushed over shouting, “miss! is it your heart?” but i was afraid to actually speak. he ran off to get help when, really, all i needed was a hand to the ladies’ room. it took three awful, dry-toast-nibbling days for that attack to pass. the one member of our party who wasn’t affected was the only one who didn’t have any salad. the irony of being poisoned by SALAD in a sushi bar…

thanks to this and other memorable encounters with the underworld of food, i understood what was happening last night when that swimming spinning roiling thing started its little dance. not good! not fucking good at all, twenty minutes before i’m scheduled to do this preso.

it’s interesting how humiliating our common bodily functions are. i knew what was happening (or about to happen) yet i stupidly couldn’t bring myself to either ask for help or run screaming out of the venue and into a cab.

that’s when i commanded the universe to Make It Stop, and the universe obeyed.

please, i said to It, give me just an hour. let me get through this gig and into a cab and then bring it on, OK? one freaking hour. i drank a cup of ginger ale, tried to respond appropriately to preshow chitchat and introductions. there was an awful movie playing in my head (and it wasn’t wag the dog), one in which i fled the stage midsentence in a headlong rush to the ladies’ without quite making it. charming.

all of a sudden it’s time to start and i shakily take my seat on the panel. just as suddenly, i’m OK. really OK — the loudmouth wisecracking poet that had been requisitioned for this show arrived in full force and effect, and the whole event comes off really well. the students love us. when finally everything winds down almost two hours had gone by. i shared a cab uptown with aartie, the liveoutloud organizer, who was going my way.

i’m not in the apartment fifteen minutes when nature resumes the taking of its course. while dutifully erasing the day’s mascara with Clarins Gentle Eye Makeup Remover, my vision doubles. my left earlobe turns red and blows up twice its usual size. what the fuck, i’ve been wearing this butchy titanium stud for the last year, how is it bothering me now? then that whole side of my neck goes scarlet. now what is THIS?

well, who knows. best i can figure out is some kind of allergy combined with the food poisoning, which then proceeded to do its thing. you always think you’re going to die, in the middle of all that (and some people do) but usually you come out of it chastened and empty as a balloon (h/t to sylvia plath for that phrase) and more or less OK.

but here’s the thing: food poisoning (or ptomaine, as my mother used to call it) typically starts thirty minutes after consuming the contaminated meal, and has its way with you for the next couple of hours or days. there is no delayed reaction opportunity, no putting it off.

so, like i said, last night i bent a tiny corner of the universe using only my mighty will. i made a deal, and the universe kept its side of the bargain.

now we know the answer to what all us obamaniacs can to do with all that leftover activist energy now that the election is successfully past: organize for gay civil rights. and boy, i think many mormons are going to regret supporting this misguided attempt at repression, no matter what their leaders preached in church.

i’ve been to my share of protests over the years, but i can’t remember one where so many signs had the word “Love” in them, and where people were totally focused and energized without being furious. the gay community, uprisen, is a formidable force indeed.

couples who married in california are now in a state of legal limbo, as the proposition didn’t make provisions for what would happen to the 18,000 gay marriages already performed in california.

i suppose they could all move to connecticut and get remarried. over there, they could care less about whether or not the gays are getting hitched.

this is the first time that a law has even been introduced, let alone passed, wherein the sole intention is to take away rights that people already have. it boggles the mind that this even made it to the ballot. i guess we were all so busy frettin’ over the election that it just didn’t get enough attention.

the attention it’s getting now will more than make up for that, as progressives — gay and straight — unite to fight for the emancipation of disenfranchised californians. the first massive, nationwide protest (which some are already calling Stonewall II) is scheduled for this coming saturday.

let me take a moment to commend the NYPD for their restraint, if not their outright support, of last night’s protest. i didn’t see or hear of a single incident between marchers and police. for that matter, i hardly saw a cop at all until 8pm, which was apparently the previously agreed-upon ending time for this action. the organizers, one of whom had a megaphone, really did a good job of focusing the energy and bringing it down naturally, after a few thousand of us arrived at the columbus circle endpoint. it wasn’t as if we were being told that it was over when some officers started gently herding us toward the sidewalk; it was more like an acknowledgment of an ending that was already well in progress.

do we REALLY have to stand out in the cold tonight in front of the manhattan mormon church to let them know how we feel about them pushing proposition 8? even worse, the meddling citizens of utah have the nerve to call the mormon’s bluff about their newfound support for gay rights. i mean, how rude can you get? can’t they tell when someone is just being polite and really doesn’t mean what they say and are just saying it to make you go away? but no, they had to make a big deal out of it and now even the congress has gotten involved. what a fuss! then melissa etheridge goes and sets a TERRIBLE example to her fellow citizens by not only refusing to pay her state taxes, but shouting the news from the ROOFTOPS for heaven’s sake.

and those uncivilized bloggers over at dailykos annoyed poor (well, not poor, we just handed them another $150 billion tax dollars, but whatever) AIG enough for them to not only respond to kos’ loudmouth complaints about their latest exec retreat, but to promise publicly to answer any further questions those meddlers may have. trying to shut them up, i guess. but it backfired: dailykos is now offering to include YOUR questions for AIG, if you’ve got any.

thousands more loudmouths, incapable of simply minding their own business, are signing the plugin car petition and adding their environmental rants to the comments, and even worse, then trying to get their friends to do the same thing. busybodies!

their punishment will be to stand out in the cold (well, it might not be cold where they are) on november 14th and 15th for the national day of action against coal.

and an onslaught, a veritable loudmouth army, the ultimate in can’t-keep-your-trap-shut failures to MYOB, is coming on january 21st (god, that sounds like a movie trailer), when GWB loses his seat, setting an army of government whistleblowers free to tell their stories of his evil and of laws he has broken that we don’t know about yet. no love for dubya? no loyalty, no sense of shame? NO. who knows, maybe there will be a movie. well, at least poor george will be memorialized somehow then, since all the cold-hearted publishers are rudely declining to publish his memoirs.

okay, end sarcasm (or </snark>, as the software engineers at my dayjob might put it). people are using their voices and forcing positive change.

and what do we get out of this deal? apparently not much, as AIG’s alleged financial crisis has already led to the cutting back or elimination of critical public transportation services like the washington metro and new jersey transit, to name just two.

corporate law experts predict a slew of indictments as a result of both corporate malfeasance before the crash and misappropriation of bailout funds after the fact. it can’t happen soon enough for me: let the perp walks begin with ceo robert willumstead.

can you tell that i am beside myself over here? these fat cat motherfuckers walking away with multimillion dollar bonuses that come out of OUR pockets. 

and it ain’t just AIG.  goldman sachs GAVE AWAY THEIR ENTIRE BAILOUT GRANT IN EXECUTIVE BONUSES. in other words, all they had to do was skip the bonuses this year, and they wouldn’t have needed a bailout. the people who mismanaged goldman sachs into near-bankruptcy get huge checks after running that company into the ground. and YOU are paying for it. I am paying for it.

new york city is cutting transit workers and cops and slashing every bit of fat out of its budget. a record-breaking 1500 newly homeless families entered the shelter system in september alone — and that’s just here. how many new homeless are there in your city?

but we sent over a hundred billion dollars to AIG. nine billion to goldman sachs. how many homeless people could be rescued (or at least housed safely) with a billion bucks? i can’t even begin to do the math.

who else is getting your money? unbelievably, the government refuses to tell us. get that? two TRILLION dollars have been distributed by the fed in some kind of deep throat operation, and they don’t want us to know where it has gone. further, the treasury department is even redacting the terms of the agreements they’ve made: the documents released so far look like letters that were censored by the KGB. and the way the bailout bill was structured means this kind of secrecy is par for the course.

and now the totally incompetent auto industry is revving into high gear and begging for a bailout of its own. NO FUCKING BAILOUTS FOR DETROIT, BARACK, OKAY? i mean, what’s next? DHL just announced it’s cutting 40,000 US jobs (yes, forty thousand, you read that right), virtually going out of business entirely in this country. should we be propping them up as well, putting the whole company on life support just because it failed to compete effectively with UPS and FedEx?

when i make bad decisions or follow a poorly thought-out strategy, i suffer the consequences. corporations should start to do the same.

there were also likely many “whatever” votes — citizens who may have known nothing about prop 8 and its implications. let’s not forget how many first-timers crawled out of their surf shacks to vote this year. i’ve heard a lot about how it was the african-american vote that doomed prop 8, those black family values… which seemed to make sense at first, but not after doing a bit more reading on the numbers and percentages involved. there simply aren’t enough black people IN california (los angeles notwithstanding) to have tipped it.

unfortunately, obama did not help on this one. he has stated before that he is not in favor of gay marriage, though he didn’t (as far as i know) speak directly to this proposition. i can understand why, politically, he wouldn’t have support this during the brual presidential campaign, and insofar as it helped him to win the election i am glad he did not: we need him in the white house. however, obama is otherwise huge supporter of gay rights — in addition to publicly calling for the repeal of DOMA (the horrid federal defense of marriage act brought to you by none other than bubba clinton) his newly stated white house employment policy goes even further:

The Obama-Biden Transition Project does not discriminate on the basis of race, color, religion, sex, age, national origin, veteran status, sexual orientation, gender identity, disability, or any other basis of discrimination prohibited by law.

meanwhile, back in sacramento, the governator is now furiously backtracking on his commitment to the log cabin republicans that he would fight for the passage of p8. he was worried that failing to support it would cost him with the republicans. guess what, arnold? you bet on the wrong fucking horse.

most people don’t lay awake nights dreaing the onset of queer nuptials. i don’t think even most right-wing republicans really give a flying fuck about it one way or another (unless they’re gay themselves) in their heart of hearts. it’s just political shorthand. i believe this to be true about abortion rights as well. otherwise it makes no sense: “i’m a right-wing republican because i believe in the sanctity of life” just doesn’t cut it with such a warlike group. more than half a million dead in iraq, and you respect the sanctity of life? not unless you’re out on the barricades trying to stop YOUR leader from perpetrating HIS (oil) war.

i digress.

apparently gay marriage is also ecumenical shorthand for the mormons who, with their millions of dollars in donations and their fairly evil advertising campaign, were the single biggest force behind the passage of proposition 8. and they are about to get their asses handed to them for it, as lawsuits seeking to remove their tax-exempt status have already commenced, and a boycott of the mormon’s big money hotel chains (including the marriot, did you know that?) is just getting started. spread the word about that boycott if you can. there’s also some talk about boycotting sundance, which is unlikely to fly. good. let’s not throw away the baby with the bathwater, shall we?

there was a huge, noisy, peaceful civil rights march in san francisco this weekend protesting prop 8. i don’t get how a confusingly-worded constitutional amendment makes it onto any ballot for a simple majority vote (a two-thirds vote is required by law for constitutional amendments, and revoking the rights of a huge class of citizens is a constitutional amendment if ever i saw one).

and speaking of protests, what the fuck is harry reid thinking? there is no way, NO WAY, joe lieberman should retain any seat of power in congress. if reid doesn’t act on this, then HE should be removed. it’s time to take the gloves off, democrats. and don’t hide behind obama, either, the way chris dodd is trying to do: barack needs you to do this for him and he needs to remain above that fray. he’s got bigger fights to win with the white house. don’t you politicans know how to read between the lines? just grow a pair and get it handled, guys.
